Dismissal for City Hunter's Appeal Sought

Question of Deputy Game Warden s Authority Involved in Case of George W. Rhone, Appellant In Case Involving Car Search.

Philadelphia - A Sunbury man asked the State Superior court today to reverse a lower court conviction on charges of failing to obey orders of a deputy game warden.

George W. Rhone was convicted last year of refusing to open tne trunk of an automobile he was driving when stopped by Edward J. Zamboni, Mount Carmel, a deputy game warden. Rhone said he had maintained at the time that he was not the owner of the vehicle.

In a brief filed with the Superior Court, Rhone said the arrest deprives him of his rights under the U. S. and state constitutions. There was no oral argument on the case.

"The defendant denies their rights to charge him with resisting inspection or arrest when the evidence clearly shows that he did not in any manner attempt to stop the officers if they wished to search the automobile which was detained for a period of 38 minutes," Rhone said in his brief.

Rhone said he told Zamboni he could not open the trunk because the car was.owned by his wife. The husband asked that the request be directed to Mrs. Rhone who was sitting in the front seat.

    H. F. Bonno, Northumberland County district attorney, told the' court in his brief that the case "does not warrant any greater expenditure of public funds." He asked that the appeal be dismissed.

Rhone was fined $100 and costs by Justice of the Peace Forrest G. Walters, Milton.President Judge Robert M. Fortney of Northumberland county, upheld the conviction last December.6
