Goshen - Charles M. Grant, 78, of 901 S. Main St., a retired groceryman, died at 3:10 p.m. Monday in Goshen General Hospital, where he was admitted seven weeks ago following a stroke. Born in Goshen Nov. 21, 1889, he married Edna Shaum March 24, 1910. At one time he operated a grocery store on N. Main St. for a number of years. He was a member of the Plymouth United Church of Christ and the Elks Lodge. Surviving are the widow; one daughter, Mrs. Margaret E. Bauer of Goshen; two sons, Maxwell of Goshen, and Dean W. of Elkhart; five grandchildren; three great-grandchildren, and two sisters, Mrs. Roy Rensberger of Goshen and Mrs. Ralph Martin of Mishawaka. Friends may call from 2 to 4 and 7 to 9 p.m. Wednesday, and on Thursday until the hour of services at 1:30 p.m. in the Yoder-Culp Funeral Home. Rev. David J. Jamieson will officiate. Burial will be in Oak Ridge Cemetery.16

According to a newspaper article 2 years later, the bride's relatives objected to her marriage to Dr. Modrack. The article also states that they had taken out their marriage license in Madison County, Indiana, where Kathleen lived, but went to Elkhart for the ceremony because of these family objections. This seems somewhat odd, as what information is known about her family at that time would only suggest that they lived in Elkhart County, and there has been no information uncovered to suggest any relatives living in Madison County.9

The Woman Relates the Story of Her Marriage, Which Occurred at Elkhart, Indidana, May 5, 1900. She Thinks the Doctor Will Write Some Day.
Mrs. Modrack, the wife of Dr. J. C. Modrack, called at the office of Justice Gompf this morning, and claimed the furniture attached under the exemption of the wife's rights. Mrs. Modrack brought the certificate of her marriage with the doctor into court in order to establish her claims.
Dr. J. C. Modrack and Mrs. Kathelen [sic] Hyde were married by Elder E. W. Clifford of Elkhart, Indiana, on May 5, 1900, but the marriage license was taken out at her home in Madison county, Indiana. The relatives of the bride objected to her marriage to Dr. Modrack, and they went to Elkhart to have the ceremony performed on that account.
Mrs. Modrack was first married when she was but sixteen years of age, and is now twenty-seven years. She told the story of the doctor's leaving Marion while in court. She still says that he had for some time been thinking of leaving Marion on account of this climate being too severe for her health, and then his practice here was not a paying one. She says that she has not heard one word from him since he left Marion, but that she expects that the doctor will write when he finds a location.
The matter of the attachment will be heard in Justice Gompf's court Saturday. With Mrs. Modrack claiming the property the case is apt to grow to be an interesting one. The attachment proceedings were brouth to satisfy a note held against Dr. J. C. Modrack by Lena Van Almen.9

The Release of Doctor Modrack
And Details of How It Is Accomplished
Is Told by the Local Correspondent of the Cleveland Leader in a Most Romantic Vein -- What a Woman's Love Will Do.
The following special, sent by the local romancer representing the Cleveland Leader to that paper and printed in its issue of today's date, will make interesting reading here. where the facts are known:
As an evidence of woman's love and devotion and what she can accomplish when forced to act is demonstrated by the fact that Dr. J. C. Modrack, who is under a penitentiary sentence, is now out of jail on bond. At the recent term of the common pleas court Dr. Modrack was sentenced to the penitentiary for a term of two years for performing a criminal operation. Ever since the sentence had been pronounced his little wife, with all the devotion and love a woman possesses, has visited the doctor daily at the jail, and in the meantime has been active in working to get her husband released and a new trial. Her efforts have been successful and Dr. Modrack breathes again the pure atmosphere and enjoys the beautiful sunshine. Mrs. Modrack went from one business man to another, pleading her cause, and as often were her pleas rejected, until about ready to give up in despair, she thought of the good, kind-hearted man, Edward Huber, the threshing machine king, the godfather of Marion, and to him she went with her heavy burden. The heart of the rich man was touched, and he signed the paper that gives Dr. Modrack the enjoyment of freedom.
The case will be taken to the circuit court on error.11

In the suit of Kathleen Modrack against M. P. Fitzgerald and John Hanley. Judge Babst has sustained the demurrer to the petition and the amendment thereto. This was an action brought by the plaintiff to recover $248 for nursing Mr. Fitzgerald during his illness. The defendant demurred to the petition and the amendment to the petition on the ground that not sufficient facts were stated to constitute a cause of action.12

In the case of Kathleen Modrack against M. P. Fitzgerald, in which the plaintiff sues to obtain $227 for care and work done for the defendant during his life, sickness and death, the plaintiff filed an amended petition, Wednesday, in which she says Maurice P. and M. P. Fitzgerald are one and the same person. She also increases her claim from $227 to $248.13

Do Nothing for Near Ones, Then Play Hog at Right Time
Hastings, Michigan, Dec. 12 - Allowing their father to go to the Poorhouse while he lived, now that he is dead Theodore Grant of Allegan, and Mrs. Adeline Ray of Nebraska, children of the late Peter Grant, have begun proceedings to gain possession of a farm valued at $2,500, formerly owned by him.
Mrs. Kathleen Modrack of Caledonia, O., now owns the farm. She is a niece of Grant, and when she heard that he was in the Poorhouse she immediately came after him and took him to her home, where she cared for him until his death. Shortly before his death he deeded the farm to Mrs. Modrack. Now the two children declare that he was incompetent when he made the transfer and have begun suit to have the transfer set aside as fraudulent.
Besides taking care of Grant, who was 93 years old when he died, Mrs. Modrack brough his body back here for burial.19

His Death is Due to Apoplexy. Sixty Years Old.
Dr. J. C. Modrak, formerly a resident of Marion, died last night at the Marion county infirmary of apoplexy. Dr. Modrack was sixty years of age. He was very well known here, having practiced medicine in Marion for a number of years and then going to Caledonia, where he practiced for several years.
Dr. Modrack had been in the infirmary for the past two months. He is survived by a widow, of Hastings, Michigan, and two sons, one living with the mother, and the other of Fort Wayne, Indiana.25

Hastings - Mrs. Kathleen Tedrow, 78, former resident of Horseshoe lake near Cloverdale, died at 4:37 a.m. today at Pennock hospital where she had been a patient for three weeks. She was a patient at the Greenfield Nursing Home here prior to her admission to the hospital. She was born Dec. 16, 1874 in Indiana, the daughter of George and Matha (Grant) Elliot. She is survived by a son, Noble F. Hyde, of Corvallis, Ore.35
